Privacy Policy

The Medical Device Manufacturing Multiplier (MDM2) Consortium (“us,” “we,” or “our”) is committed to maintaining the privacy of the personally identifiable information you share with us over the Website. MDM2 values the trust and confidence you have placed in us and, to ensure that we live up to your trust, we have defined the procedures we will use to protect your information.

As part of the normal operation of our services, MDM2 collects and, in some cases, may disclose information about you. We have created the following Privacy Policy to let you know what information we collect when you visit the Website, why we collect it, and how it is used, shared, and protected. This Privacy Policy applies to all information that you provide to MDM2 and that we maintain electronically. Additionally, this Privacy Policy applies to any Personal Information (defined below) obtained from your use of the Website. This Privacy Policy does not apply to any information that you may provide to third parties e.g., other sites linked to this Website. You should contact such third parties directly to determine their respective privacy policies.

 

a. SPECIAL NOTE ABOUT CHILDREN

MDM2 does not currently market to or create special areas for use by children. Accordingly, we do not knowingly collect age identifying information or any Personal Information from children under the age of 13 years. However, we hereby advise all visitors to our site under the age of 13 not to disclose or provide any Personal Information on our website. In the event that we discover that a child under the age of 13 has provided Personal Information to us, in accordance with the Children’s Online Privacy Protection Act (please see the Federal Trade Commission’s website at www.ftc.gov/kidzprivacy for more information about this Act), we will delete the child’s Personal Information from our files to the extent technologically possible. This Website is targeted primarily for use by adults, meaning persons twenty-one (21) years of age and older. If you are under the age of 21, we ask that you do not provide any Personal Information to us.

 

b. WHAT PERSONAL INFORMATION DO WE COLLECT FROM YOU AND WHY?

MDM2 does not collect personally identifiable information about individuals except when such individuals specifically provide such information on a voluntary basis. For example, such personally identifiable information may be gathered in connection with requests for information and/or application forms or comments entered through the Website. Types of personal information we collect from you on a voluntary basis might include your:

  • name

  • mailing address

  • phone number and/or fax number

  • e-mail address

  • business name, mailing address, phone and/or fax number, and e-mail address

  • product interests and posted comments or questions

Before or at the time of collecting personally identifiable information, we will identify the purposes for which such information is being collected. MDM2 will collect and use personally identifiable information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes. Personally identifiable information on individual users will not be sold or otherwise transferred to unaffiliated third parties without the approval of the user at the time of collection. If you choose not to provide personal information, we may not be able to provide you with the information or other services you request.

Opt-Out and Access Choices

At such points of collection, the user will have the opportunity to indicate whether he or she would like to “opt out” of receiving information about us and/or any third parties.  You may “opt out” of certain communications at any time.  Most of our communications are sent by e-mail, text message, and direct mail, though you may opt out of telephone calls and online behavioral advertising as well.  You may also change your personal information or ask us to do so.

To do so yourself, you may:

  • follow opt-out “unsubscribe” instructions in promotional e-mails we send to you, or follow “block” instructions to remove your contact information and prevent the email list from adding your name again;

  • set the Tools function of your browser to not receive cookies (please note this may make it difficult or impossible to access all of the features on our Website); or

  • text STOP to text messages (SMS/MMS) we send to you (message and data rates may apply).

When mailing or emailing us, please include your full name, address, phone number, and e-mail address.  Also, tell us what information you would like to access, change, or add to our “opt-out” list.  This will help us process your request.

Further, notwithstanding any opt out of promotional information by the user, we reserve the right to contact a subscriber regarding account status, changes to the subscriber agreement and other matters relevant to the underlying service and/or the information collected.

Your Rights and Your Personal Data under the GDPR and UK GDPR

Unless subject to an exemption, if your personal data is subject to the GDPR or UK GDPR you have the following rights with respect to your personal data:

  • The right to request a copy of your personal data which we hold about you;

  • The right to request that we correct any personal data if it is found to be inaccurate or out of date;

  • The right to request your personal data be erased where it is no longer necessary for us to retain such data;

  • The right to withdraw your consent at any time to the processing of personal data to which you provided consent for processing;

  • The right to request that we provide you with a copy of your personal data and where possible, to transmit that data directly to another data controller (known as the right to data portability);

  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction be placed on further processing;

  • The right to object to the processing of personal data (where applicable); and

  • The right to lodge a complaint with a data supervisory authority.

Please note that we may verify your identity before we are able to process any of the requests described in this Section, and in our discretion, deny your request if we are unable to verify your identity. As a part of this process, government or other identification may be required. Additionally, several of the above rights are not absolute and apply only in certain circumstances.  We will comply with requests for those rights as set forth in the GDPR or the UK GDPR. We are intent on resolving any issues relating to our handling of your Personal Information, and you may contact us at any time regarding any questions or concerns.

 

c. WHAT GENERAL INFORMATION DO WE COLLECT FROM YOU AND WHY?

“General Information” is information about you or your activities on our Website that do not identify you personally. When you use the Internet, your web browser or software may communicate certain information to the host website you visit through the use of cookies, web beacons, and other technologies. A “cookie” is a small file that is transferred to your hard disk for record keeping purposes. It does not contain information that would personally identify you, although it could enable website hosts to relate your use of the website to information that you have specifically and knowingly provided to the same website.

General Information may include the unique number assigned to your server or Internet connection (your IP address), the capabilities and features of your computer, your geographic location, the number of times you visit a particular website, which pages you visit,  your movement and your interaction within that website on each visit, the length of time you spend on the website, and the webpage you visited before and after visiting the website.

We collect the same information on this Website. We use this General Information to generate general aggregate statistics about visitors to our Website and helps us to recognize you and customize your Website experience by making our marketing messages more relevant.  We also use these web technologies for reporting and analysis purposes, such as how you visit our Website, performance of our marketing efforts, and performance of our Website.

Third Parties

In some circumstances we allow third-party companies to collect certain information when you visit our Website and to use that information for advertisement or messaging purposes for MDM2 or services of other companies, including those affiliated with MDM2, when you visit our Website or other websites.

Social Media Widgets

Our Website may include social media widgets, such as the Facebook “Like” button, Google Plus, YouTube, Pinterest, and Twitter widgets.  These features may collect information about your IP address and which page you are visiting on our Website, and they may set a cookie to make sure their feature functions properly. Social media features and widgets are either hosted by a third party or hosted directly on our Website.  Your interactions with those features are governed by the privacy policies of the companies that provide them.

Chat Widget

The Chat widget is an instant messaging service implemented by MDM2 to support members of the public. Chat is provided on an “as is” and “as available” service. MDM2 disclaims all responsibility and liability for the availability, timeliness, security, or reliability of this service or accuracy of responses. Content is intended for information purposes only and does not constitute and shall not be relied on as professional or legal advice. MDM2 may modify, suspend, or discontinue the service with or without notice and without liability to anyone. Use of Chat does not trigger a legal relationship and MDM2 does not accept any liability for any injury, loss, or damage incurred by use of or reliance on the information and advice provided via the service and you hereby release MDM2 and the Chat representative from any such liability. MDM2 is committed to your privacy and agrees to use your information for internal use only. MDM2 may keep transcripts of your session for quality assurance, training, and anonymized reporting purposes only.

Video and Photography

We may use cameras at our events or other activities in which MDM2 is involved.

 

d. HOW WE USE YOUR INFORMATION

Examples of how the Personal Information that MDM2 collects are used include, but are not limited to:

(i) respond to inquiries or comments;

(ii) provide customer services and resolve any complaints;

(iii) improve the Website and marketing efforts and service and resolve any technical problems by conducting historical, statistical, scientific, business or other research and analysis, including, but not limited to, traffic and usage patterns on our Website;

(iv) communicate with you concerning the services offered on the Website;

(v) send newsletters and other informational or marketing communications to you;

(vi) cross-reference with other Personal Information that we have acquired about you or may acquire about you through other sources;

(vii) create aggregate data;

(viii) comply with any applicable laws and regulations, including but not limited to preventing fraudulent activity by monitoring against theft and computer crimes to otherwise protect the public, including our donors stakeholders, employees, agents, vendors and other affiliated entities, and investigating claims, incidents or inquiries regarding stakeholders, donors, employees, agents and vendors assisting law enforcement and other government entities in response to legal, regulatory and related inquiries and requirements;

(ix) enforce the Terms and Conditions of Use relating to our Website; and

(x) perform other activities as needed, or as described elsewhere in this Privacy Policy.

We do not and will not use your information for solicitation purposes or to sell you goods or services. The MDM2's sole purpose is to attract and grow quality businesses and advocate for Greater Phoenix’s competitiveness.  If any communication sent by us is considered a solicitation it will immediately be corrected.

 

e. HOW WE SHARE THE INFORMATION WE COLLECT

We may provide your Personal Information to our Partners as part of business operations, transaction processing, and marketing efforts, as identified below. For purposes of this Privacy Policy, “Partner” shall mean any person or entity with whom we enter into any kind of business transaction who is under an obligation to us to use reasonable care to keep your Personal Information confidential. These entities may use your information to offer you membership, services, event invitations, or information that may be of interest to you.

Except as provided in this Privacy Policy, MDM2 will not sell, trade, or disclose to third parties who are not Partners any Personal Information obtained by us or from our Partners about you through this Website without your consent.

We may disclose Personal Information:

(i) that we in good faith believe is necessary or appropriate to cooperate in investigations of fraud, intellectual property infringements, or other activity that is illegal or may expose us or you to legal liability;

(ii) when required by law or to comply with a court order, subpoena, search warrant or other legal process, or by other reasonable request from law enforcement;

(iii) to comply with legal, regulatory or administrative requirements of governmental authorities (including, without limitation, requests from the governmental agency authorities to view your Personal Information);

(iv) to protect and defend us, our subsidiaries and affiliates and any of their officers, directors, employees, attorneys, agents, contractors and partners, in connection with any legal action, claim or dispute;

(v) to protect our non-profit status;

(vi) to prevent imminent physical harm;

(vii) to share aggregated statistical or demographic data with our affiliates, business partners or for public relations (this aggregated information is not tied to Personal Information);

(viii) to provide data, including Personal Information about you, with our affiliates, subsidiaries Partners, and companies that provide services to us (such as a printer, e-mail marketers, analytics providers, web hosting providers, or call center service providers) to assist us in managing a database of customer information, distributing e-mails or text messages, direct marketing and data collection, and other services designed to assist us in maximizing our business potential; and

(ix) to enforce or apply applicable Terms and Conditions of Use and other agreements.

MDM2 may disclose general aggregate statistics derived from General Information with our Partners or third parties who are not Partners. In the event we merge or are acquired by another company, the successor company will have access to your Personal Information in order to continue to provide services but would continue to be bound by this Privacy Policy unless and until it is amended as described in the subsection labeled “Changes to this Privacy Policy” below. In the event that some or all of our assets are sold or transferred, we may also retain a copy of that customer information.

 

California Disclosures

If you are a California resident and have an established business relationship with us, you can request a notice disclosing the categories of personal information we have shared with third parties, for the third parties’ direct marketing purposes, during the preceding calendar year. To request a notice, please submit your request to info@mdm2.org. Please allow 30 days for a response.

If you provide us with personal information, we and other third parties may track your personal information as described in this privacy policy, including your movements on our website, mobile applications and social networks or in our stores. Such tracking allows us and third-party providers to ease and customize your shopping experience. Neither MDM2 nor its third-party providers have a systematic method for ensuring “Do Not Track” functionality in certain browsers can operate to prevent tracking.  You may be able to opt out of certain types of “tracking” by utilizing the opt-out service at the Network Advertising Initiative at www.networkadvertising.org/choices/#completed.

 

f. HOW WE PROTECT INFORMATION WE COLLECT

MDM2 will protect personal information by reasonable administrative, technical, and physical security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. MDM2 employs a variety of security measures to protect the data that you submit to the Website. These measures include a combination of policy, physical, and electronic measures that are intended to reduce the risk of unauthorized access to this data. When we collect or transmit sensitive information, we use commercially reasonable methods to protect that information.

However, no website, computer network, or any internet connected system is completely secure or immune to cyber-attack, and therefore we cannot guarantee the security or privacy of any information that we collect or store. You are also responsible for taking reasonable steps to protect your personal information against unauthorized disclosure or misuse.

E-mail Security

“Phishing” is a fraudulent scam designed to steal your personal information.  If you receive an e-mail that looks like it is from the MDM2 Consortium asking you for your personal information, do not respond to it. We will never request your password, user name, credit card information or other personal information through e-mail.

 

g. HOW LONG WE KEEP USER INFORMATION

MDM2 generally keeps user data on our server or in our archives for as long as we reasonably need it. We may alter this practice according to changing requirements. For example, we may delete some data if needed to free up storage space. We may keep other data for longer periods if the law requires it. Data management requests are administered in an orderly manner to the extent feasible and within our direct control. Please note that we have greater control over recently collected data than over archived data. Once data is removed from the system and archived, it may not be feasible to accommodate specific requests. In those cases, our general data retention policy applies.

 

h. CHANGES TO THIS PRIVACY POLICY

By using this Website, you agree to this Privacy Policy. We reserve the right to change, modify, or amend this Privacy Policy at any time. When this Privacy Policy is changed, modified, or amended, the revised Privacy Policy will be posted on this Website and be incorporated within the Website’s Terms and Conditions of Use. Any revised Privacy Policy will only apply prospectively to Personal Information collected or modified after the effective date of the revised policy. It is your responsibility to periodically check and review our Privacy Policy for changes.
